10. Visa-Related Requirements for successful candidates
Successful candidates must comply with current Korean immigration laws. Particularly, those who hold an E2 visa or want to apply for an E2 visa must provide the following documents:
A. A certificate of degree
The Immigration Law requires applicants for an E2 visa to submit a copy of applicant's diploma or graduation certificate or certificate of degree which has an Apostille stamp or verification from the Korean Embassy in applicant's own country. Please have them ready so that you could earn your E2 visa before March 1, 2013.
B. Apostilled Criminal Record Check
(1) The Immigration Law requires applicants for an E2 visa to submit an apostilled Criminal Record Check which covers the whole country's information (or notarized by the Korean Consulate, depending on the applicant's nationality) to the Immigration Office. Applicants who have never submitted one to the Immigration Office are strongly recommended to submit one to the Immigration Office at their earliest convenience. Applicants who currently have a tourist visa should submit an apostilled Criminal Record Check to the Immigration Office to apply for an E2 visa, even though they have submitted one to the Immigration Office before.
(2) A Criminal Record Check must be properly issued by the applicant's federal government and then apostilled. Please consult with the embassy of the applicant's country about how to obtain an apostilled Criminal Record Check.
(3) Canadian or Chinese citizens must have their Criminal Record Check notarized, not apostilled, by either the Korean Consulate in their country or the embassy of their country in Korea, because Canada and China have not joined the Apostille (1961 Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents).
(4) Applicants must submit an apostilled (or notarized) Criminal Record Check issued within six months of the date of submission to the Immigration Office.
It is imperative that successful candidates who currently hold an E2 visa or want to apply for an E2 visa should have the documents listed above ready by early February so that the visa application can be made in time and eventually be able to earn an E2 visa by the date of March 1, 2013. Particularly, those who have an E2 visa currently or want to apply for an E2 visa are strongly recommended to apply for an apostilled (or notarized) Criminal Record Check early in advance as it may take longer than expected to get one issued.
Please be aware that the decision on the applicant's employment will be revoked if he or she fails to obtain a properly issued visa by March 1, 2013.
